A federal judge has struck down Pfizer Inc.'s patents on its erectile dysfunction drug, Cialis, and blocked a similar suit to bring the suit against the drug's makers.
The lawsuit against Eli Lilly and Co. has been before a U. S. court since May 2014.
Pfizer Inc.'s patent covering Cialis, a generic version of Viagra, has since expired, but a panel of experts has rejected its application, ruling that the drug had a non-statutory patent infringement under 35 U. C. §101 et seq. and therefore invalid.
The suit, filed on Friday in the Southern District of New York, was filed in the Southern District of New York, and in a separate case filed in the Eastern District of New York.
Pfizer is seeking to overturn a decision of the FDA that allowed the use of Cialis, its generic equivalent, for the treatment of erectile dysfunction. The company had challenged a decision that was overturned in a 2005 decision, but has not yet been overturned by the FDA.
Under the Hatch-Waxman Act, the Food and Drug Administration can determine whether a drug’s claims are “regarded by reason of patentee validity” unless it is not.
The issue of validity was the only one of record in the case. The FDA rejected the drug, citing a lack of prior approval.
A panel of experts, including the company's own lawyers and its counsel, also voted down the panel’s recommendation.
In the case, Pfizer submitted the first application for a patent on Cialis, which it had filed earlier this year, but was rejected by the FDA. The company had challenged the decision in a 2008 decision, but had not submitted the application.
The panel's decision to reject the drug was based on a “disproportionate” number of applications submitted by Pfizer.
The company had argued that, in light of the “disproportionate” number of applications submitted by the drug’s makers, the decision was not an “unreasonable” one. It was also not an “unreasonable” one because Pfizer did not have to prove each of the FDA’s factors to overcome the invalidity of the patent.
The company appealed the decision, but the district court upheld the decision. The company appealed the decision to the Federal Circuit.
On appeal, the district court ruled that a failure-to-warn theory was not justified, and that the patent was infringed.
Pfizer appealed, but the Federal Circuit has denied the appeal.
The case is now before a panel of the Supreme Court.
